Sex Crimes Law in Texas

In Texas, sexual offenses are covered under Chapters 21 and 22 of the Penal Code. Sexual offenses, including non-consensual sexual contact, sexual assault, sexual abuse, public lewdness, and indecent exposure, are characterized either by force or by intent for sexual gratification.

Felony sexual offenses

In Texas, the most serious sexual offenses are classified as felonies and carry serious penalties. Felonious sexual offenses include:

  • Improper relationship between an educator and a student
  • Improper photography or visual recording

Sexual abuse of a child and aggravated sexual assault are first-degree felonies, often punishable by a minimum of 25 years in prison. Sexual assault, indecency with a child, and an improper relationship between an educator and a student are classified as second-degree felonies and are punishable by two to 20 years in prison. Improper photography or visual recording constitutes a state jail felony, punishable by a jail sentence of at least six months and at most two years.

Misdemeanor sexual offenses

The following sexual offenses are categorized as misdemeanors in Texas:

  • Public lewdness
  • Indecent exposure

A person commits public lewdness when he or she engages in any sex act in a public place or in a private place and is reckless regarding whether others might be offended. Public lewdness is a Class A misdemeanor, punishable by a maximum fine of $4,000 and a maximum jail term of one year. A person commits indecent exposure when he or she exposes his or her genitals with the intent to arouse or gratify sexual desire, and is reckless with regard to whether others might be offended. Indecent exposure is a Class B misdemeanor, punishable by a maximum fine of $2,000 and a maximum jail term of six months.
